Akatsuki Limited, LLC, registered with the Malta Business Registry under number C 109512, with its registered office at 23 FL 3/11 'SOUTH HOUSE', TRIQ HOMPESCH, FGURA, FGR 2010, Malta (hereinafter the "Publisher") is committed to protecting the Personal Data that may be collected and processed from its Domo application (hereinafter the "Application").
You may be required to provide Personal Data (as defined below) when downloading and browsing the Application as well as when purchasing Products offered by the Publisher.
As the Data Controller, the Publisher undertakes to protect your Personal Data in accordance with the applicable regulations, in particular Regulation (EU) No. 2016/679 of 27 April 2016 known as the "General Data Protection Regulation" or "GDPR" and French Law No. 78-17 of 6 January 1978 known as the "Data Protection Act" as amended (hereinafter the "Applicable Regulations").
This document constitutes the privacy policy implemented by the Publisher and is intended to inform you of the commitments and practical measures taken to ensure the respect and protection of Personal Data (hereinafter "Privacy Policy").

Product: Any physical product, digital product, or paid digital content offered for sale by the Publisher on the Application. The purchase of certain Products may additionally include tokens allowing the User to participate in promotional games and lotteries.
Data Controller: means the natural or legal person, or other body, which alone or jointly with others determines the purposes and means of the processing;
Processor: means the natural or legal person, or any other body, which processes Personal Data on behalf of the Data Controller;
Processing: means any operation or set of operations performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.
User/You: Any person downloading the Application, browsing it, and, where applicable, purchasing Products.

This Personal Data is retained by the Publisher for the duration of the contractual relationship with the User or until the account is closed.
Please note that the Publisher uses third-party payment service providers whose terms of use are available at: https://www.nuvei.com/en/legal/terms-of-use. Payment data is retained only for the duration of the transaction.

This Personal Data is retained by the Publisher until you withdraw your consent or for 3 years from your last contact with the Publisher.

So that the Publisher can ensure compliance with its legal obligations in accounting, tax matters, and for the retention of evidence in the event of disputes or litigation, in the Publisher's legitimate interest to ensure its defense and the preservation of its interests:

This Personal Data is retained by the Publisher for the periods mentioned for the other processing above, then kept as intermediate archives for the time required to comply with legal and limitation obligations.
If you do not wish to provide certain Personal Data, the Publisher may not be able to ensure your navigation on the Application or access to its Products.
2.2. Recipients of Personal Data
As part of a strict access and confidentiality management policy, only duly authorized recipients by the Publisher may access the information you have provided to us.
The Personal Data collected may be processed within the following departments of the Publisher: management, sales, IT, marketing;
Third parties authorized by law, such as judicial or administrative authorities;
Business partners for prospecting purposes (based on your consent);
Subcontractors and external service providers:
The Personal Data collected may also be transmitted to the Publisher's subcontractors and service providers, within the limits provided by the applicable provisions and in accordance with this Privacy Policy.
In all cases, subcontractors only process your Personal Data on behalf of the Publisher. In their contractual relationships with the Publisher, these subcontractors undertake to comply with the Applicable Regulations.
2.3. Transfer and hosting of Personal Data
Personal Data collected is hosted within the European Union and is not transferred or processed outside the European Union.
However, if the Publisher transfers Personal Data outside the European Union, it guarantees that such transfers are made to countries that are subject to an adequacy decision by the European Commission, justifying an adequate level of protection within the meaning of Article 45 of the GDPR.
In the absence of an adequacy decision, the Publisher may transfer Personal Data outside the European Union to subcontractors, under the conditions provided for by the applicable regulations, in particular by concluding standard contractual clauses approved by the European Commission.
2.5. Security measures implemented
The Publisher undertakes to ensure the security and integrity of your Personal Data.
To this end, the Publisher implements and maintains technical and organizational security measures for the Application and its information system appropriate to the nature of the Personal Data and the risks presented by their Processing.

You also have the right to contact any competent supervisory authority, such as the CNIL, if you believe that the processing of your Personal Data violates the requirements of the applicable regulations.
This Privacy Policy may be amended in line with the development of the Application and Products, as well as legislative and regulatory changes and in light of the recommendations of the French Data Protection Authority (CNIL). The version of the Privacy Policy applicable is the one available on the Application on the day of its use.
